These Terms of Service ("Terms") govern your use of the My Custom Jewish Calendar website, calendar builder, account features, and ordering services (collectively, the "Service"). By accessing or using the Service, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian. You must provide accurate account information, keep your password confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account.
The Service
The Service lets you create personalized Jewish calendars, add dates and events, upload photos, save projects, generate print-ready PDFs, and, when ordering is available, purchase printed calendars. Some features may be available without an account and stored only in your browser. Features, products, formats, prices, and availability may change over time.
Calendar information
Jewish dates, holidays, candle-lighting times, Havdalah times, Torah portions, and other calendar information may be calculated using third-party data and the location and settings you select. You are responsible for reviewing all dates, spellings, locations, customs, and times before relying on or printing a calendar. The Service is not a substitute for advice from a qualified rabbinic authority, and you should independently verify information used for religious observance.
Your content
You retain ownership of photos, text, personal events, and other content you submit ("User Content"). You grant us a limited, non-exclusive license to host, copy, process, modify for formatting, generate PDFs from, print, and transmit User Content only as needed to operate the Service, fulfill your requests and orders, maintain security and backups, and comply with law. This license ends when the content is deleted from active systems, except for temporary backup copies and records we must retain.
You represent that you own or have permission to use all User Content and that our processing, printing, and fulfillment of it will not violate another person's copyright, privacy, publicity, or other rights. You are responsible for obtaining consent before uploading personal information or images of other people, including children.
Acceptable use
You may not use the Service to:
- violate any law or another person's rights;
- upload unlawful, infringing, deceptive, abusive, hateful, obscene, or malicious content;
- attempt to access another user's account, private projects, photos, PDFs, orders, or data;
- interfere with security, availability, or operation of the Service;
- introduce malware, scrape the Service at unreasonable volume, or bypass technical limits; or
- use the Service or its output to misrepresent identity, affiliation, or authority.
We may remove content or restrict access when we reasonably believe these Terms have been violated or action is needed to protect users, third parties, or the Service.
Orders, prices, and payment
Prices, shipping charges, taxes, product specifications, and estimated delivery information will be shown during checkout when ordering is available. You authorize us and our payment processor to charge the payment method you provide for the total shown. An order is subject to acceptance, payment confirmation, print-file validation, and fulfillment availability. We may reject or cancel an order and issue an appropriate refund if we cannot produce it, suspect fraud, identify a rights violation, or discover a pricing or technical error.
Payments may be processed by Stripe or another payment provider under that provider's terms. We do not control a payment provider's independent services.
Personalized printing and proofs
Printed calendars are personalized using the project and PDF approved or generated from your selections. Before ordering, you are responsible for checking names, dates, text, photo placement, cropping, image quality, page order, calendar range, and shipping information. Screen colors and previews may differ from printed output, and minor variations in color, trimming, binding, paper, and placement are normal in physical production.
Fulfillment may be completed by a third-party printing and shipping provider. Delivery dates are estimates unless expressly guaranteed. Title and risk of loss pass as provided by applicable law and the shipping terms presented with your order.
Cancellations, returns, and refunds
Because calendars are made to order, production may begin soon after an order is accepted. Cancellation or changes may not be possible once production begins. Except where required by law or stated in a separate policy presented at checkout, personalized products are not returnable solely because of customer-provided errors or a change of mind. If an order arrives damaged, defective, or materially different from the accepted order, contact us promptly with the order details and supporting photographs so we can evaluate a replacement or refund. Nothing in these Terms limits non-waivable consumer rights.
Our intellectual property
The Service, excluding User Content, including its software, design, branding, templates, text, and other materials, is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable right to use the Service for personal or other authorized purposes in accordance with these Terms. No other rights are granted.
Third-party services
The Service may use or link to third-party services for Jewish calendar data, location search, payments, email, printing, fulfillment, shipping, hosting, or other functions. Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party sites or services except to the extent required by law.
Service availability and changes
We may maintain, modify, suspend, or discontinue any part of the Service. We do not guarantee uninterrupted access or permanent storage. You should retain copies of important photos, calendar data, and generated files. We may impose reasonable technical limits and remove abandoned projects or obsolete files in accordance with our Privacy Policy.
Suspension and termination
You may stop using the Service at any time and may request account closure. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, fail to pay amounts due, or misuse the Service. Provisions that by their nature should survive termination, including payment obligations, intellectual-property terms, disclaimers, liability limitations, and dispute provisions, will survive.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that calendar calculations, previews, generated files, or third-party information will always be accurate or suitable for your particular religious, legal, or printing requirements. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by law, My Custom Jewish Calendar and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from the Service or these Terms. Our aggregate liability for a claim will not exceed the greater of the amount you paid us for the Service giving rise to the claim during the twelve months before the event or 100 US dollars. These limitations do not apply where prohibited by law.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless My Custom Jewish Calendar and its owners and personnel from third-party claims, damages, and reasonable costs arising from your User Content, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.
Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except to the extent mandatory law in your place of residence applies. Before filing a claim, you and we agree to make a good-faith effort to resolve the dispute informally. Any court proceeding must be brought in a state or federal court with jurisdiction in Illinois, unless applicable law gives you the right to bring it elsewhere.
Changes to these Terms
We may update these Terms as the Service changes. We will post updated Terms with a new effective date and provide additional notice when required. Changes apply prospectively unless otherwise stated. Your continued use after updated Terms take effect means you accept them.
